These Terms and Conditions govern the sale of hardware and related provisioning services through selbsai.com by ALB Digital Dienstleistungen.
1. Scope
These Terms apply to orders, configurations, customer-portal use, preload or provisioning services, and other services offered through this website unless a separate written agreement expressly overrides them.
The shop is designed for consumers, freelancers, and business customers. Mandatory consumer-protection rights apply where the customer acts as a consumer. Business customers remain responsible for assessing whether the system is suitable for their professional, regulatory, and IT-security requirements.
2. Product presentation and contract formation
Product descriptions, configuration options, indicative lead times, and technical statements on the website are not a binding legal offer. They are an invitation to submit an order.
A binding contract is formed only once the operator accepts the order, for example by order confirmation, separate acceptance, or dispatch of the goods.
The order confirmation e-mail, invoice, receipt, and customer portal may be used to document the selected configuration, price, delivery address, payment status, and provisioning state.
3. Prices and payment
Unless otherwise stated, prices are shown in EUR. For consumers within the EU, prices should be understood as including statutory VAT where legally applicable. Any shipping, insurance, customs, or similar extra costs must be shown before checkout is completed.
Payment processing is carried out through Stripe. The checkout currently presents the payment methods made available there for this shop, including card payments, SEPA Direct Debit, and Klarna where offered for the relevant order context.
4. Delivery and lead times
Delivery times are indicative unless expressly confirmed otherwise. Where the ordered device includes customer-specific setup, preload, or configuration work, any stated lead time may begin only once the required data, approvals, or customer inputs have been received.
If components become unavailable due to supply constraints or lifecycle changes, equivalent components may be used so long as the essential characteristics and intended use are not materially impaired.
Shipping is currently handled through DHL to the destinations offered in checkout.
5. Customer configurations and uploaded materials
Where devices are configured to customer requirements or loaded with customer materials, the customer is responsible for ensuring that the configuration requested and the files supplied may lawfully be used for that purpose and do not infringe third-party rights.
Customers must maintain their own backups of uploaded files. Uploaded materials are used only for the agreed provisioning, testing, and related support.
Preload uploads are not a long-term backup, archive, or hosting service. After provisioning and verification, customer-provided preload files may be deleted from provisioning storage according to the retention policy.
6. Retention of title
Delivered goods remain the property of the operator until full payment has been received.
7. Software, open-source components, and models
Devices may include free software, open-source software, open-weight models, and other third-party components. The corresponding licence terms of those components apply in addition to these Terms.
Unless explicitly agreed otherwise, the customer receives only the rights necessary for the intended operation of the delivered system. Mandatory rights arising from open-source licences remain unaffected.
Model behaviour is probabilistic. Outputs can be incomplete, inaccurate, or unsuitable for legal, medical, tax, financial, architectural, employment, or public-administration decisions without qualified human review. selbsai is an assistance system, not a substitute for a licensed professional decision-maker.
8. Updates, support, and security
Updates may include security fixes, operating-system updates, application updates, model changes, or compatibility work. Unless expressly agreed otherwise, updates are provided at selbsai's discretion and may depend on third-party hardware, operating-system, model, or package availability.
Security reports can be sent to security@selbsai.com. The public disclosure contact is also published through security.txt.
9. Defects, support, and warranties
Statutory warranty rights apply. Any additional support commitments, update scope, or voluntary warranty promises apply only to the extent expressly described in the product or order context.
10. Liability
Liability is unlimited in cases of intent, gross negligence, injury to life, body, or health, under mandatory product-liability rules, and to the extent of any expressly assumed guarantees.
In the event of slight negligence, liability for breach of essential contractual obligations is limited to foreseeable damage typical for the contract. Mandatory consumer rights remain unaffected.
11. Right of withdrawal for consumers
Consumers may have a statutory right of withdrawal. Details are set out in the withdrawal information.
For clearly customer-specific or personalised goods, the right of withdrawal may be excluded under Section 312g(2) No. 1 BGB. The checkout and order-review flow identifies the built-to-order and individually configured nature of these systems and points to the withdrawal information.
12. Governing law and dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that mandatory consumer-protection provisions of the country of habitual residence are not displaced.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board unless a mandatory rule requires otherwise in the future.
